Terms of Service

01Acceptance of Terms

These Terms of Service (the “Terms”) govern your use of the JumpKit mobile application (the “App”) and the JumpKit website (together, the “Services”), operated by JumpKit (“JumpKit”, “we”, “our”, or “us”). By creating an account, downloading, installing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.

If you download the App from the Apple App Store, your use is also subject to Apple’s standard Licensed Application End User License Agreement (the “Apple EULA”); if you download it from the Google Play Store, your use is subject to the Google Play Terms of Service. Where these Terms conflict with Apple’s or Google’s terms, the platform terms control with respect to your use of the App on that platform.

02Eligibility

You must be at least 13 years old to use JumpKit.

If you are between 13 and the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.

03Your Account & Sign-In

You create an account by signing in with Apple Sign-In, Google Sign-In, or a one-time code sent to your email address. We do not maintain a password for you; the security of your account depends on the security of the identity provider you choose. You are responsible for:

  • Keeping your sign-in provider account secure
  • Providing accurate information during onboarding
  • All activity that occurs under your account
  • Notifying us promptly through the contact page if you suspect unauthorised access

04License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial athletic training purposes.

You may not:

  • Sell, rent, lease, sublicense, distribute, or transfer the App
  • Copy, modify, translate, or create derivative works of the App
  • Reverse-engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits despite this limitation
  • Remove or alter any proprietary notices, branding, or labels
  • Use the App or any part of it to build a competing service, train a competing AI/ML model, or extract training-program content at scale

05Acceptable Use

When using the Services you agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose
  • Attempt to access another user’s account, data, or systems without authorisation
  • Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure
  • Interfere with, disrupt, or place an undue load on the Services
  • Upload content that is unlawful, infringing, defamatory, harassing, or that depicts a person other than yourself without their permission
  • Submit deliberately false or misleading information designed to manipulate the AI coach or the program generator
  • Use the Services to develop, train, or evaluate a competing product

06Subscriptions & Billing

JumpKit offers Pro subscriptions and, where available, a one-time lifetime purchase. Subscription titles, durations, and prices (including any introductory or promotional pricing) are shown in the App at the point of purchase. All purchases are processed by Apple (App Store) or Google (Play Store).

Auto-renewal

  • Subscriptions automatically renew at the end of each period unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your Apple ID or Google Account will be charged for renewal within 24 hours before the end of the current period at the displayed renewal price.
  • Payment is charged to your App Store or Google Play account at confirmation of purchase.

Managing or cancelling a subscription

You can manage or cancel your subscription, or turn off auto-renewal, at any time in your Apple ID Settings → Subscriptions or Google Play → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current paid period; you retain access to Pro features until then.

Free trials

If we offer a free trial, the trial converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds

Refunds are handled by Apple or Google in accordance with their own policies. JumpKit cannot directly issue refunds for App Store or Google Play purchases. Statutory consumer rights (including any applicable EU or UK rights of withdrawal) are unaffected.

Price changes

If we change the price of a subscription, we will notify you in accordance with Apple’s or Google’s price-change rules. You may cancel before the new price takes effect.

07AI-Generated Content

The training programs, exercise instructions, coaching feedback, motivational nudges, and chat replies surfaced in the App are generated in whole or in part by artificial-intelligence models (currently including Anthropic Claude and OpenAI). AI output can be incomplete, inaccurate, or inappropriate for your specific circumstances.

You are responsible for evaluating AI-generated content before relying on it and for adjusting or skipping any exercise or recommendation that does not feel safe, suitable, or appropriate for you.

08Health & Safety Disclaimer

JumpKit is a training and education tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

Vertical-jump training involves physical activity (including plyometrics and resistance work) that carries a risk of injury, including serious injury. Before starting, changing, or stopping any exercise program, you should consult a qualified healthcare or fitness professional, especially if you have a pre-existing condition, injury, or limitation, are pregnant, take medication that affects exertion or balance, or are returning from injury.

Do not rely on JumpKit for emergency or urgent medical situations. If you experience pain, dizziness, shortness of breath, or any symptom that concerns you, stop training immediately and seek qualified medical attention. You assume all risk arising from your use of the Services and the training programs they generate.

09Your Content

You retain ownership of the jump videos, profile information, and other content you submit to the Services (“Your Content”). You represent and warrant that you have all rights necessary to submit Your Content and that doing so does not violate any third-party right or applicable law (for example, that you have permission from anyone visible in a video you upload).

You grant JumpKit a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, and display Your Content solely as needed to operate the Services for you (for example, running pose-estimation on a jump video, surfacing your workout history back to you, and providing AI coaching). This licence ends when you delete the content or your account, except for backup copies retained for a short period to operate the Services.

We will not use Your Content to train third-party generative-AI models without a separate, clearly worded opt-in from you.

10Intellectual Property

The App, the website, the JumpKit name and logo, and all software, designs, text, graphics, sounds, exercise libraries, default program templates, and other materials provided through the Services (excluding Your Content) are owned by JumpKit or its licensors and are protected by intellectual-property laws. Except for the limited licence granted to you in these Terms, no rights are granted to you by implication or otherwise.

If you believe content available through the Services infringes your intellectual-property rights, please contact us through our contact page with sufficient detail for us to investigate.

11Third-Party Services

The Services depend on third-party platforms and providers, including but not limited to Apple, Google, Supabase, RevenueCat, Anthropic, OpenAI, Vercel, Formspree, and Expo. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, content, or conduct of any third-party service, and a third-party outage or change may affect parts of the Services without notice.

12Disclaimers

To the maximum extent permitted by applicable law, the Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied, statutory, or otherwise. JumpKit specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.

We do not warrant that the Services will be uninterrupted, secure, error-free, or that any AI-generated content, biomechanics measurement, form grade, or training recommendation is accurate, appropriate for you, or will produce any specific result (including any specific improvement in vertical jump). Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

13Limitation of Liability

To the maximum extent permitted by applicable law, JumpKit and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months preceding the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

14Indemnification

You agree to defend, indemnify, and hold JumpKit and its officers, directors, employees, contractors, and agents harmless from and against any claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) Your Content; (c) your breach of these Terms; or (d) your violation of any law or any rights of a third party.

15Termination

You may stop using the Services at any time and delete your account from within the App (Settings → Delete Account). Deletion removes your personal data as described in our Privacy Policy.

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, if continued provision of the Services to you would expose us or other users to legal or security risk, or if we discontinue the Services in whole or in part. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, and indemnification) will survive.

16Modifications to the Service or Terms

We may update the Services and these Terms from time to time. When we change the Terms, we will update the “Last updated” date at the top of this page. For material changes, we will provide reasonable advance notice through the App, the website, or by email where appropriate. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to a change, your remedy is to stop using the Services and delete your account.

17Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which JumpKit operates, without regard to its conflict-of-laws rules. To the extent permitted by applicable law, you and JumpKit agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the EU, UK, or another jurisdiction with mandatory consumer-protection rules, you retain the benefit of any non-waivable protections of the law of your country of residence, and you may bring proceedings in the courts of that country.

18Severability & Entire Agreement

If any provision of these Terms is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any platform terms (Apple EULA, Google Play Terms), constitute the entire agreement between you and JumpKit regarding the Services and supersede any prior agreements.
